O R D E R
The writ petition is filed seeking the following prayer: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue a writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 3rd respondent herein in not taking action or registering a crime against Respondent No.4 herein on the written report made by the petitioner, dated 02.04.2016 as illegal, arbitrary and also opposed to all cannons of justice and also opposed to the verdict passed by the Apex Court in Lalitha Kumari Vs. State of UP in WP (Criminal) No.68/2008, dated 12.11.2013, consequently direct the 3rd respondent to register a crime against Respondent No.4 herein basing on the written report made by the petitioner herein on 02.04.2016 forthwith by taking appropriate action against them and to pass such other order or orders as this Hon'ble Court may deem fit just and proper in the circumstances of the case."
Learned Assistant Government Pleader for Home, based on written instructions dated 05.05.2016, submits that a case in Crime No.65 of 2016 has been registered against respondent No.4 for the offences punishable under Section 420 read with 34 I.P.C., on 05.05.2016.
In view of the said submission of the learned Assistant Government Pleader, nothing further survives for adjudication in the writ petition.
The Writ Petition is accordingly closed.
Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
