SMT JUSTICE T.RAJANI CRIMINAL PETITION No.1786 of 2018 ORDER:

This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioner, who is accused No.1 in Crime No.396/2017, dated 18.12.2017 on the file of Station House Officer, Kurnool II Town Police Station, Kurnool District. The offences alleged are under Sections 447, 506 r/w 34 of IPC.

Heard the learned counsel for the petitioner/accused No.1, learned Public Prosecutor appearing for the respondent-State, and perused the record.

As per the case of the prosecution, the petitioner/accused No.1 forged the documents, as if the house of the de facto complainant was sold by her. The counsel for the petitioner/accused No.1 submits that earlier, the case filed by the de facto complainant was referred as Civil case. But the learned public prosecutor submits that the petitioner/accused No.1 herein is involved in five other cases and that he is a habitual offender.

Hence, in the above circumstances, this Court is not inclined to grant anticipatory bail to the petitioner/accused No.1. This criminal petition is dismissed. However, the petitioner/accused No.1 is at liberty to surrender before the lower Court, having jurisdiction and

seek regular bail. On such petition being filed, the lower Court concerned, shall dispose of the same, on merits, expeditiously, preferably on the same day, subject to pressure of other work. 5.

Accordingly, with the above observation, the Criminal Petition is dismissed.

As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
