HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.4660 of 2015 ORDER:
This writ petition is filed seeking writ of Mandamus declaring the action of respondents 6 to 8 in dispossessing the petitioners from the possession and enjoyment of their respective lands, total in an extent of Ac.27.67 cents of Veduruwada Village, Achutapuram Mandal, Visakhapatnam District, as arbitrary and illegal.
2. Heard the learned counsel appearing for the petitioners and the learned Government Pleaders for Land Acquisition and Revenue-respondents 1 to 7. 3 . Admittedly, the issue involved in this writ petition fell for consideration before the learned single Judge of this Court in WP No.14312 of 2008, wherein the learned single Judge after considering all aspects of the matter held that the respondents have followed the procedure and passed orders of resumption or cancellation and that the petitioners failed to place any material before the Court in support of their case that they are in possession of petition lands either at the time of filing of the writ petition or as on date. Holding as such, the learned single Judge refused to entertain the writ petition and dismissed the same. Since the matter has been already adjudicated in the aforesaid writ petition, this writ petition is not maintainable for further adjudication of the same issue.
4. Hence, the writ petition is dismissed at the stage of admission. No order as to costs. Pending miscellaneous petitions, if any, in this writ petition shall stand dismissed in consequence.
