HON'BLE SRI JUSTICE SURESH KUMAR KAIT & HON'BLE DR JUSTICE SHAMEEM AKTHER W.P. No. 42378 of 2015 O R D E R:- (ORAL) (Per Hon'ble Sri Justice Suresh Kumar Kait) Sri P.V. Ramana, learned counsel for the petitioner, after advancing some arguments, submits that the petitioner retired from service on 31.01.2014, whereas charge sheet was filed on 16.01.2014 and reply thereto was already filed on 06.08.2014, however till date, no enquiry officer has been appointed, thus, departmental enquiry could not be conducted. He further submits that the issue raised before the Tribunal in O.A. is that the respondents have not allowed the petitioner for encashment of his leave for 300 days for the reason that charge sheet was filed on 16.01.2014 i.e. even before his retirement.

In view of the above submission, this Court, without going into the controversy raised by the learned counsel for the petitioner, directs the respondents to appoint an enquiry officer if not already appointed and conclude departmental proceedings, within a period of four months from the date of receipt of a copy of this order.

With the above direction, the writ petition is disposed of. No order as to costs.
