HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No. 24474 OF 2007 ORDER:
This writ petition is filed questioning the action of the Tahsildar, Marredpalli Mandal-second respondent in invoking the provisions of the Revenue Recovery Act vide Notice No.C/522/07, dated 31.10.2007 for effecting recovery of an amount of Rs.2,95,950/- towards outstanding dues payable to the third respondent along with interest @ 6% per annum and also directing to pay 10% of the amount to the second respondent on the amount payable to the third respondent as per the directions, as illegal and arbitrary.
Today, when the matter came up for hearing, learned counsel for the petitioner produced a copy of the Office Order of the third respondent, vide Ref.No.PEE/III/757, dated 8.5.2014 which reads as follows:
" In compliance to Notice No.PEE/III741 dated 8.5.2014, name of Sh. T.Anand Mahesh, Trainee Officer (PR), Emp No.102932H is struck off the rolls of NHPC with effect from 17.02.2005, in accordance with Rule No.3.2.17 of NHPC Leave Rules.
The final dues of Sh.T.Anand Mahesh, Trainee Officer (PR), Emp No.102932H will be cleared by Finance Division on receipt of 'NO DEMAND CERTIFICATE' from all concerned. All Divisions in the Corporate Office are therefore requested to send their Demand/No Demand Certificate in respect of
Sh.T.Anand Mahesh, Trainee Officer (PR) to Chief (Finance), Salary Section, Corporate Office latest by 15.5.2014. In case, the same is not received on or before 15.05.2014, it will be presumed that nothing is outstanding against him and his final dues will be cleared accordingly."
Learned counsel for the petitioners, basing on the above Office Order dated 8.5.2014, submitted that no further orders are necessary in this writ petition.
In view of the submission made by learned counsel for the petitioners, the Writ Petition is closed, as no further orders are necessary in this writ petition. Miscellaneous petitions pending if any, shall stand closed. No order as to costs.
