THE HONOURABLE Dr.JUSTICE G.RADHA RANI CRIMINAL PETITION No.2556 OF 2024 ORDER:

This Criminal Petition is filed by the petitioners - Accused Nos.7 and 8 under Section 438 Cr.P.C. for grant of anticipatory bail in the event of their arrest in Crime No.155 of 2023 on the file of the Station House Officer, Chennaraopet, Warangal District, registered for the offence under Section 307 read with Section 34 of the Indian Penal Code.

The case of the prosecution in brief was that on 07.08.2023 at about 14:00 hours, the de-facto complainant/Jinukala Bhagyalaxmi lodged a report to the Police stating that one Karre Ravi and one Chippa Eshwar were having disputes between themselves and Chippa Eshwar asked the husband of de-facto complainant to accompany him to the Panchayath on 06.08.2023. When the husband of de-facto complainant went to the panchayath, Karre Ravi abused him and on the same day night, the petitioners and six others came to her house, abused her husband and her father-in-law and beat them with sticks causing injuries.

Basing on the said report, the above said crime was registered for the above said offence.

Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor representing the respondent-State. 5.

The learned counsel for the petitioners submitted that the petitioners did not participate in the attack, no specific allegations were made against the petitioners, Accused Nos.1, 3 to 6 were arrested on 28.08.2023 and were released on bail, the petitioners were women and prayed to enlarge the petitioners on anticipatory bail in the event of their arrest.

Learned Additional Public Prosecutor reported that the incident occurred on 06.08.2023 and some of the accused persons were arrested and enlarged on bail.

Perused the record. Considering that the alleged incident occurred long back on 06.08.2023 and as seen from the Remand Report of Accused Nos.1, 3 to 6, the role of the petitioners was stated to be only that they caught hold the de-facto complainant and beat her with hands and as the other accused were enlarged on bail and the petitioners were woman, it is considered fit to enlarge the petitioners on anticipatory bail in the event of their arrest on certain conditions.

Accordingly, the Criminal Petition is allowed and the petitioners - Accused Nos.7 and 8 shall be released on anticipatory bail subject to the following conditions:

1) The petitioners-Accused Nos.7 and 8 are directed to surrender before the Station House Officer, Chennaraopet Police Station, Warangal District, within a period of 15 days from the date of this order. On such surrender, the said Station House Officer shall release the petitioners on bail on their executing personal bonds for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) each with two sureties for a like sum each to the satisfaction of the said Station House Officer. 2) The petitioners-Accused Nos.7 and 8 shall abide by the conditions stipulated under Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigation of the case.
