HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P. No.186 of 2015 ORDER:

This petition is filed to withdraw A.S.No.103 of 2012 from the file of VII Additional District Judge, Warangal, and transfer the same to VIII Additional District Judge, Warangal, where A.S.No.5 of 2011 is pending.

2. Heard both sides.

3. As per affidavit filed in support of petition, petitioner herein filed O.S.No.1000 of 2006 for the relief of declaration that she is legal heir of late S.Veera Lakshmi and similarly respondent herein filed O.S.No.1002 of 2006 seeking a declaration that he is the legal heir of very same S. Veera Lakshmi and both the suits were tried together and dismissed, against which two separate appeals are filed by respective parties and one is now pending before VII Additional District Judge, Warangal and the other is pending before VIII Additional District Judge, Warangal and both these cases have to be tried by one Court.

4. Other side has no objection for transfer of the appeals to either of the Courts.

5. Considering the reasons stated in the affidavit, A.S.No.103 of 2012 is withdrawn from VII Additional District Judge, Warangal, and transferred to VIII Additional District Judge, Warangal, for disposal in accordance with law.

6. Accordingly, transfer C.M.P. is ordered.

7. Miscellaneous petitions pending, if any, shall stand closed.
