Heard the learned counsel for the writ petitioner and the learned Assistant Government Pleader for Revenue.
As per the submissions of the learned counsel and the material available on record it could be seen that the claim of the father of the petitioner in respect of the subject land of the writ petition, for grant of occupancy rights certificate was rejected by the 3rd respondent - Revenue Divisional Officer in file No.L/1043/1999 dated 24.4.2003 on the ground that the subject land is Government / Poramboke land and that no claims for occupancy rights certificate can be entertained on Government lands. The said order attained finality. The 4th and 5th respondents herein filed Inam Land Case No.5136/2012 before the 3rd respondent for occupancy rights certificate in respect of the same subject land. The petitioner got impleaded in the said case.
Pending the same, filed the present writ petition seeking for a direction to the 3rd respondent - Revenue Divisional Officer, Rajendranagar Division, Rangareddy, to conduct enquiry as envisaged in Section 10 of the Telangana Abolition of Inams Act, 1955 with regard to classification of the subject land and grant occupancy rights certificate. When the proceedings of the 3rd respondent dated 24.4.20033 rejecting the claim of the father of the petitioner for occupancy rights certificate in respect of the subject land attained finality, it is not known how the petitioner can again seek for a direction to conduct enquiry for grant of occupancy rights certificate. I do not see any merit in the writ petition same is dismissed at the stage of admission.
No order as to costs.
