THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL REVISION CASE No.2185 OF 2017 ORDER:
This revision is filed aggrieved by the judgment dated 18.04.2017 passed in Crl.A.No.65 of 2016 by the III Additional Sessions Judge, Karimnagar.
Heard learned counsel for the petitioner and the respondents. Perused the record.
Learned counsel for the petitioner-husband would submit that there was no marriage between the petitioner and respondent No.1. The Court below granted excess maintenance to the respondent-wife. He has health problems. He is spending lot of money towards his maintenance. Respondent No.1-wife had already received Rs.1,50,000/- in the presence of elders. Respondent No.1-wife is working as Warden and getting income of Rs.4,000/- per month. The Court below did not take all the above facts and circumstances into consideration and granted the maintenance.
It is evident from the record that the petitioner-husband is a retired teacher. He has sufficient means to maintain his wife. There is specific evidence of respondent No.1-wife that she was driven out of the house forcing her to live separately. She has no means to maintain herself. Petitioner herein did not enter into the witness box. The petitioner herein disputed the marital life between him and respondent No.1. Both the Courts below have taken all the facts and circumstances of the case into consideration and awarded maintenance. There is no miscarriage
of justice. There is nothing to vary or interfere with the order passed by the Court below.
In the result, the Criminal Revision Case is dismissed. The Miscellaneous Petitions, if any, pending shall stand closed.
