THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 21209 of 2016 ORDER :

This Writ Petition came to be filed with the following prayer:

"...to pass an order, direction, writ more appropriately one in the nature of writ of mandamus declaring the action of the Respondent Nos. 1 to 4 in not removing the illegal structure raised over the way leading to the Municipal Park showing it as adjacent to H.No.8-2293/82/L/44A/A opposite to the Andhra Bank ATM in MLA Colony, Road No.12, Banjara Hills, Hyderabad as illegal, arbitrary, against the principle of natural justice, violative of articles 14, 15 and 21 and 22 of Constitution of India and consequently direct the Respondent Nos.1 to 4 to demolish the entire structure standing on the premises adjacent to H.No.8-2-293/82/L/44A/A opposite to the Andhra Bank ATM in MLA Colony, Road No.12, Banjara Hills, Hyderabad and pass..."

2. Heard the learned counsel for the petitioner and Sri P.Keshava Rao, learned Standing Counsel for respondents 2 to 4. At the request of both the counsel, the Writ Petition itself is taken up for disposal at the stage of admission.

3. Though various grounds are urged in the Writ Petition, learned counsel for the petitioner restricts his prayer seeking a direction to respondents 2 to 4 to consider and pass appropriate orders on the representation dated 16.05.2016 made by the petitioner.

On the other hand, learned Standing Counsel appearing for respondents 2 to 4 would state that the authority concerned would take action in accordance with law if the representation dated 16.05.2016 made by the petitioner is still pending consideration.

4. In view of the same, without going into the merits of the case, the Writ Petition is disposed of directing the respondent No.2 to consider and pass appropriate orders in accordance with law on the representation dated 16.05.2016 made by the petitioner, as early as possible preferably within a period of six weeks from the date of receipt of a copy of this order, after giving opportunity of hearing to the petitioner and all aggrieved persons. Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed in the light of this final order. No order as to costs.
