THE HONOURABLE SMT JUSTICE ANIS CRIMINAL PETITION No.14070 of 2016

ORDER

This petition under Section 482 Cr.P.C. is filed by the petitioners/A1 to A5 seeking to quash the proceedings in Cr.No.487 of 2016 of Women Police Station, Hyderabad District, registered for the offences punishable under Sections 498-A and 506 IPC and under Section 4 of Dowry Prohibition Act, against them. 2.

Heard learned counsel for the petitioners/accused and learned Additional Public Prosecutor representing the State.

Learned counsel for the petitioners argued that the marriage of the complainant with the first petitioner was performed on 12.12.2010 in Kengal Temple at Bangalore and it is love marriage and thereafter, they lived happily for some time and after moving to Hyderabad, the complainant started harassing the first petitioner and his family members. He further argued that the mother of first petitioner i.e., third petitioner is bed ridden due to ill health and is not in a position to move from the bed. He also argued that all the petitioners have not committed any offence and they are innocent and the second respondent filed this false complaint against the petitioners.

4. The material on record would show that the investigation in this case is not yet completed and the charge sheet is not filed. At this stage, this Court cannot interfere with the investigation. However,

ANIS,J Crl.P.14070 of 2016 this Court can pass order restraining the police from arresting the petitioners 2 to 5/A2 to A5.

In the facts and circumstances of the case, the Criminal Petition is disposed of, directing the investigating agency to proceed with the investigation, however, without arresting petitioners 2 to 5/A2 to A5, except the first petitioner/A1, till filing of charge sheet or final report in the above crime. The petitioners 2 to 5/A2 to A5 shall appear before the investigating agency as and when required during course of investigation.

Miscellaneous applications, if any, pending in this criminal petition shall stand closed.
