THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.13443 of 2016 ORDER:

The present application is filed under Section 438 Cr.P.C., seeking release in the event of the arrest of the petitioner in an unregistered crime to be registered on the basis of a report given by the wife of the petitioner.

Learned Pubilc Prosecutor, on instructions, submits that no crime is registered till now.

Having regard to the circumstances stated above, the investigating agency shall follow the Judgment of the Apex Court in Arnesh Kumar v. St at e of Bihar and anot her 1 and Section 41 of Cr.P.C., if any crime is registered pursuant to the report given by the wife of the petitioner relating to the offences punishable for a term of less than seven years.
