THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7937 OF 2016 ORDER:

This petition is filed by the petitioner-accused No.1 under Section 438 Cr.P.C. seeking to grant bail in Crime No.69 of 2016 on the file of RGI Airport Police Station, Cyberabad, registered for the offences punishable under Sections 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act.

Heard and perused the material available on record. Learned Counsel for the petitioner submitted that the marriage of the petitioner and the de facto complainant was solemnized without any demand of dowry and dowry was not given or taken at the time of marriage and now, the question of dowry does not arise and that the de facto complainant filed a false complaint. The learned Additional Public Prosecutor submitted that serious allegations were made against the petitioner and therefore, it is not a fit case to grant bail to the petitioner.

Earlier, the petitioner moved bail application before the Additional Metropolitan Sessions Judge, Cyberabad and the said application was dismissed on the ground that the contents in the complaint would attract the ingredients, which would constitute prima facie case against A1. On perusal of the complaint, it is obvious that serious allegations were made against the petitioner-A1. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
