THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9388 of 2015 ORDER:

This Criminal Petition is filed by the petitioner-Accused No.2 under Section 438 Cr.P.C. seeking to grant anticipatory bail to him in Crime No.1047 of 2014-2015 on the file of Prohibition & Excise Station, Narsipatnam, Visakhapatnam District, registered for the offence punishable under Sections 8(c ) r/w 20(b)(ii)(c ) of the NDPS Act.

It is alleged that in the vehicle of the petitioner, 200 kgs of ganja was transported by A1. On the basis of the confession made by A1, the petitioner was arrayed as accused in the above crime. It is stated that the investigation was completed and the charge sheet has also been filed. It is also brought to the notice of this Court that NBWs are pending against the petitioner.

Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner. The petitioner-Accused No.2 is directed to surrender before the Court concerned, where the charge sheet was filed, on or before 14th October, 2015 and file an application to recall NBWs, if any, issued against him. On such surrender and on such application being filed, the Court concerned is directed to recall NBWs and release the petitioner on condition of the petitioner executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with one surety for the like sum. The surety should be the native of Andhra Pradesh.
