Heard learned counsel for the petitioner, and the learned Standing Counsel appearing for Achampet Municipality. Learned Standing Counsel, on specific instructions, submits that the Roads and Buildings (R&B) Department who had proposed to take up the road widening has decided to defer the proposal of widening the road. In those circumstances, learned Standing Counsel submits that the impugned notice could be set aside, however, by giving liberty to the respondent authorities to take up the road widening work in the event of there being necessity in future.

Having regard to the submissions made by the learned Standing Counsel on specific instructions, the writ petition is disposed of by making it clear that the respondent authorities shall not take any action pursuant to the impugned notice, and the authorities would take further action only after following due process afresh in the event the property of the petitioner is required for the purpose of road widening.
