HON'BLE SRI JUSTICE SURESH KUMAR KAIT WRIT PETITION No.30453 of 2016 ORDER:

Vide the present petition, the petitioner questions the inaction of respondent No.3 in referring the matter to the Civil Court, despite his representation dated 20.08.2016. Learned counsel for the petitioner submits that, for the aforesaid relief, the petitioner made representation dated 20.08.2016. However, till date, no communication has been received by the petitioner.

Learned Government Pleader for the Land Acquisition submits that award proceedings has not yet commenced. Therefore, the present Writ Petition is premature. Keeping in view the averments in the Writ Petition, and the submission of the learned Government Pleader for Land Acquisition, I hereby direct respondent No.3 to dispose of the representation of the petitioner dated 20.08.2016. The decision taken shall be communicated to the petitioner within a period of one week from the date of decision.

Till the decision is taken on the said representation, compensation shall not be disbursed in favour of respondent No.6.

With the above direction, the Writ Petition stands disposed of.

Miscellaneous Petition pending, if any, shall also stand disposed of. However, in the circumstances, without costs.
