THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.13235 of 2015 ORDER:
This criminal petition is filed under Section 482 Cr.P.C., to quash the docket order dated 23.5.2014 in C.C. No.200 of 2014 on the file of the court of Judicial Magistrate of First Class, Nandyal.
2. Heard the learned counsel for the petitioner.
3. The docket order passed by the learned Magistrate is as follows: "Complainant absent. Petition filed and allowed. Accused present. Copies of documents furnished under Section 207 Cr.P.C. The accused is directed to execute bond for 1⁄2 of cheque amount. Call on 27.6.2014. Sri K.S.R., Advocate filed M.A. for accused."
The contention of learned counsel for the petitioner is that the condition imposed by the learned Magistrate causes much inconvenience and hardship to the petitioner; hence, he requested to modify the order.
4. Having regard to the facts and circumstances of the case, the condition in the order dated 23.5.2014 is modified as follows. The petitioner is hereby directed to execute a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety for a like sum to the satisfaction of the learned Judicial Magistrate of First Class, Nandyal.
5. With the above modification, this criminal petition is allowed. Miscellaneous petitions, if any pending in this criminal petition, shall stand closed.
