HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.9237 OF 2015 O R D E R :

This writ petition is filed seeking Writ of Mandamus declaring the action of the respondents in contemplating to close the petitioner's hostel by issuing closure notice in File No.2903/A/SLP/LO/GHMC dated 29.03.2015 issued by the 2nd respondent, without considering the representation dated 30.03.2015, as illegal and arbitrary and for a consequential direction to set aside the same. The case of the petitioner is that he is running a hostel in the name and style of Sri Maruthi Luxury PG for Ladies and Gents Hostel. While so, the 2nd respondent issued a closure notice dated 29.03.

2015, asking the petitioner to obtain/renew the trade license by submitting the requisite documents and license fee within three (03) days from the date of receipt of copy of the said notice and on failure of the same, action will be initiated as per the Rules of GHMC Act. Pursuant to the said notice, the petitioner made a representation dated 30.03.2015 to the 1st respondent seeking extension of time for payment of trade license fee. But the respondents without considering the same are trying to close the petitioner's hostel. Aggrieved by the same, the present writ petition is filed.

Heard the learned counsel for the petitioner and Dr.Y.Padmavathi, learned Standing counsel for the respondents.

Since it is stated that the representation made by the petitioner is pending consideration, the respondent authorities are directed to consider the same and thereafter take action in accordance with law. Till such time, status-quo obtaining as on today shall be maintained by both the parties. With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions, pending, if any shall stand closed.
