THE HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY AND THE HON'BLE SRI JUSTICE G.SHYAM PRASAD WRIT PETITION No.653 of 2016 Date:24.06.2016 Between:

The District Educational Officer, Medak District at Sanga Reddy, and others.

.. Petitioners and D. Mettu Ramulu s/o. Pandu Ranga Sarma and another.

.. Respondents Counsel for the Petitioners: Government Pleader for Services Counsel for Respondent No.1: Mr. Rudresh Deshpande for Mr. M.Ramgopal THE COURT MADE THE FOLLOWING:

ORDER: (Per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This writ petition is filed for certiorari to quash order, dated 30.11.2015, in O.A.No.4516 of 2015 on the file of the Andhra Pradesh Administrative Tribunal at Hyderabad (for short 'the Tribunal'). At the request of the learned Government Pleader for Services (T.S), this writ petition was directed to be posted under the caption "for orders" as this is stated to be covered by order dated 11.03.2016 in W.P.No.7413 of 2016. We have seen the above-mentioned order as well as the record and find that the facts in the present case are similar to that in W.P.No.7413 of 2016, except that in the present case, respondent No.1 has not joined at Z.P.High School, Salabathpur.

The learned Government Pleader submitted that in view of the status quo granted by this Court, respondent No.1 has not been working either at Salabathpur or at Sadasivapally. In our opinion, as serious allegation of manipulation of counselling is made, it is not appropriate to allow respondent No.1 to work at Sadasivapally. Instead, respondent No.1 shall immediately report to duty at Salabathpur till petitioner No.2 exercises his power under Rule 17 of the Rules framed under G.O.Ms.No.12 dated 16.06.2015, as directed by this Court in W.P.No.7413 of 2016. The entitlement of respondent No.1 to work at Sadasivapally depends upon the final outcome of the decision of petitioner No.2. Subject to the above observations, this writ petition is disposed of in terms of order dated 11.03.2016 in W.P.No.7413 of 2016 with

the direction that the time schedule stipulated in para 6 of the said order commences from today.

As a sequel to disposal of the writ petition, interim order dated 07.01.2016 is vacated and WPMP.No.808 of 2016 & WVMP.No.722 of 2016 are disposed of as infructuous.
