THE HON'BLE SRI JUSTICE RAJA ELANGO Crl.R.C. No.1410 of 2015 ORDER :

The petitioner preferred the present Criminal Revision Case by invoking the provisions under Sections 397 and 401 of the Code of Criminal Procedure being aggrieved by the order dated 10-07-2015 passed in Crl.M.P.No.38 of 2015 in Crl.A.No.140 of 2015 by the Judge, Family Court, Kurnool.

2. Heard and perused.

3. The lower appellate court after considering the submissions of the petitioner herein granted stay of operation of trial court order dated 01-07-2015 on condition that the petitioner shall deposit 50% of arrears of interim maintenance on or before 21-07-2015. Further, the lower appellate Court directed the petitioner to continue to pay the 50% of interim maintenance awarded by the trial Court. Considering the same, this Court is not inclined to interfere with the impugned order passed by the lower appellate court.

4. Accordingly, the Criminal Revision Case is dismissed. However, the trial Court is directed to dispose of the case within a period of three months from the date of receipt of a copy of this order.

5. Miscellaneous petitions filed in this revision, if any, shall stand closed.
