HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.18492 OF 2017 ORDER:

This writ petition is filed by the petitioners challenging the action of respondents Nos.2 and 3 in interfering with their peaceful possession and enjoyment over their house sites in Sy.No.451-1, situated at Vijayanagar Colony, backside RDT Office, Anantapuram, without issuing any notice or without following the due process of law.

It is the case of the petitioners that they are in occupation of small extents of house sites in the above survey number and most of them constructed houses. While so, the respondents visited their house sites and directed them to vacate the above sites by stating that the said sites belong to the Government. Hence, the petitioners filed this writ petition. 3.
Heard and perused the material available on record. 4.
The main grievance of the petitioners is that respondents Nos.2 and 3 are interfering with their possession over the house sites in question, without following the due process of law. It is submitted on behalf of the respondents that the respondents intend to remove the unauthorized constructions made by the petitioners.

Considering the facts and circumstances of the case and the submissions made by both the Counsel, without expressing any opinion on merits, this Court is inclined to pass the following order: "The respondents are directed not to take any coercive steps in connection with the house sites in question. The respondents are directed to follow the due process of law, if
they intend to remove any constructions in the house sites in question or if they intend to acquire the above said sites." 6.
