Burra Satyanarayana v. L. Nageswar Rao And Another
THE HON'BLE SRI JUSTICE T.AMARNATH GOUD M.A.C.M.A.No.198 OF 2014 ORDER:
This appeal is preferred by the appellant questioning the judgment of the XXII Additional Chief Judge-cum-Motor Accident Claims Tribunal, City Criminal Court, Hyderabad (for short, Tribunal) in O.P.No.1226 of 2006 dated 23-12-2009, on the ground that the compensation awarded by the Tribunal is very meager. 2.
Heard. Sri T.Ramulu, learned counsel appearing for the second respondent vehemently opposed and prayed to dismiss the appeal.
3.
It is seen from the judgment of the Tribunal, it has applied the multiplier of 13, instead of 14, which is the multiplier to be taken for the age of 45. If the correct multiplier of 14 is applied, the compensation would come to Rs.5,79,675/- as against Rs.5,43,675/- as awarded by the Tribunal. Rest of the judgment remains unchanged. The enhanced amount shall be paid to the appellant on payment of deficit Court fee as he paid Court fee claiming an amount of Rs.5,00,000/-.
4.
Accordingly, the Motor Accident Civil Miscellaneous Appeal is allowed in part. Miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
