I THE HONOURABLE SRI JUSTICE E. V. VENUGOPAL CRIMINAL PE?ITION No. 1 128O oF 2015 ORDER:

This criminal petition is frled by the petitioners/accused No.1 to 5 and 7 seeking to quash the registration of Crime vide FIR No.258 of 2015 dated 20.07.2015 by the Moinabad police Station, Ranga Reddy District against the petitioners herein on the ground of abuse of process of law and consequently to set aside the complaint of the 2"d respondent dated 09.07.2015. 2.

There is no representation on behalf of petitioner on 3.11.2023 and 10.11.2023 and even today when the matter is listed under the caption Tor dismissal'.

Learned counsel for the unofficial respondent is present. 4.

Mr. Vizaratlr Ali, l,earned Assistant Public prosecutor is present and would submit that unless and until investigation in the crime is conducted truth cannot be elicited and further submits that the sentence imposed to the alleged offences is \ \ below 7 years and hence seeks to dismiss the criminal petition. 5.

Having regard to the submissions, this Court is of the view that unless and until investigation is allowed to be continued

truth cannot be elicited. The alleged offences are punishable with less than seven years. In the said circumstances, since the punishment prescribed for the offences alleged against the petitioners under section 42O, 465, 468, 471, 448, 427, 506 of IPC are less than seven years, without going into merits of the matter, the respondent-Police are directed to strictly follow the procedure as contemplated under Section 41-A of Cr.P.C. and the guidelines formulated by the Honble Supreme Court in Antesh Kutnar a. State oJ Blharr scrupulously and to complete the investigation as expeditiously as possible, since the matter is pending from long time, preferably within three (3) months from the date of receipt of the order of this Court. It is needless to say that, any deviation in this regard wilt be viewed seriously. The petitioners are also directed to cooperate and assist with the investigation.
