HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 14842 OF 2017 O R D E R :
This Writ Petition is filed seeking a mandamus to declare the action of Respondents 2 and 3 in not considering the representation of the petitioner for allotment of alternate plot against plot No. 57 under EWS category situated at Bathukammakunta, Bagh Amberpet Village, Hyderabad as arbitrary and illegal.
The case of the petitioner is that she was allotted plot No. 57 in an extent of 60 square yards under EWS category, but however, the said land was cut across by an MCH open nala, thereby depriving him 15 square feet. When similarly-situated persons, viz. M. Naga Bhushan Sharma and others have made a request to the respondent authorities bringing to their notice the said fact, they were granted alternate plots. Heard learned counsel for the petitioner as well as Sri Chatla Madhu, learned Standing Counsel for the Corporation. In the facts of the present case, the respondent authorities are directed to consider the representation of the petitioner and if the plot allotted to her was affected by the open nala, they shall consider granting alternate plot, as is being done in the case of others.
The Writ Petition is accordingly, disposed of. No costs. Consequently, the miscellaneous Applications, if any shall also stand disposed of.
