HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 7387 OF 2017 ORDER:

This writ petition is filed challenging the impugned endorsement of the 2nd respondent dated 03.10.2016 rejecting the application of the petitioners for issuance of Family Members Certificate and Earning Member Certificate.

Learned counsel for the petitioners submits that without giving any reasons, the impugned endorsements have been passed. He also submits that the procedure as envisaged under G.O.Ms.No.145 Revenue (SER.II) Department, dated 25.04.2015 for grant of Family Members Certificate is not being followed while passing impugned endorsements.

On the other hand, learned Assistant Government Pleader for Revenue, on written instructions, submits that the 2nd respondent has conducted enquiry.

It is to be seen that both the impugned endorsements dated 03.10.2016 are without assigning any reasons. In view of the same, the impugned endorsements dated 03.10.2016 are liable to be set aside and accordingly set aside. Since it is stated that the 2nd respondent has already conducted enquiry, the 2nd respondent is directed to dispose of the applications of the petitioner for grant of Family Member Certificate and Earning Member Certificate in terms of G.O.Ms.No.145, Revenue (SER.II) Department, dated 25.04.2015 and take action accordingly.

With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
