HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 5427 of 2016 ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for Civil Supplies appearing for the respondents.

The petitioner has been appointed as Fair Price Shop Dealer for Shop No. 34 of Pulaguttapalli village, Guntakal Mandal, Ananthapur district. Based on the report submitted by the third respondent on 09.06.2015, the second respondent, after following the due procedure, cancelled the authorization of the petitioner through his order dated 26.09.2015. Aggrieved by the same, the petitioner preferred an appeal along with stay application before the fourth respondent. When no orders have

been passed by the fourth respondent either on the stay application or in the appeal, the petitioner filed the present Writ Petition.

When the appeal preferred by the petitioner is pending adjudication before the fourth respondent, this Court is disinclined to go into the merits or otherwise of the subject matter. In view of the same, it is just and proper to direct the fourth respondent to dispose of the appeal preferred by the petitioner within a time frame.

Accordingly the fourth respondent is directed to consider and dispose of either stay application or appeal itself filed by the petitioner against the order dated 26.09.2015, on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.

The Writ Petition is disposed of at the admission stage. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
