HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE S.V.BHATT W.P. No.16527 OF 2004 PC:
The petitioner prays for Mandamus declaring the closure of B.C. (Boys) Hostel, Chintavaram while giving effect to G.O.Ms.No.32, Backward Classes (B2) Department dated 30.06.2004, as arbitrary, ultra vires and unconstitutional. The petitioners pray for a direction to continue the hostel for B.C. students at Chintavaram Village.
In spite of receipt of notice from the Court, the District Collector/2nd respondent did not file reply.
From the material available on record, we notice that while establishing a hostel for girls, the hostel meant for B.C. (Boys) is relocated. In our view the establishment of a hostel for girls ought not to have resulted in relocation of hostel meant for boys. The writ petition was filed in the year 2004. Learned counsel appearing for the respondents could not and did not place before the Court the present status on this issue. Therefore, the District Collector, Nellore is directed to examine the grievance set out in the writ affidavit and take decision within a period of eight weeks from the date of receipt of a copy of this order and in the process the 2nd respondent ensures continuation of the hostel facilities both for boys and girls. The Registry is directed to enclose a copy of the affidavit along with this order while communicating to the District Collector.
The writ petition is disposed of as indicated above. No costs. Consequently, miscellaneous petitions, if any pending, also stand disposed of.
