HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.6025 of 2019 ORDER:

This writ petition is filed seeking the following relief :- " ..... to issue an appropriate order or direction more particularly a writ of Mandamus declaring the action of the 3rd respondent in not considering the case of the petitioner for appointment on compassionate grounds in an suitable post as per her suitability and eligibility in view of the death of her husband while in service, even though the petitioner submitted the representation on 08.02.2018 and subsequently along with all the relevant documents as illegal, arbitrary, unjust, improper and contrary to the rules and violation of principles or natural justice and consequently direct the 3rd respondent to consider the case of the petitioner for appointment on compassionate grounds in any suitable post as per her suitability and eligibility by considering the representation submitted by the petitioner on 08.02.2018 ....." .

Heard Mr.S.Surender Reddy, learned counsel for petitioner and the Special Government Pleader for Home.

It has been contended by the petitioner that her husband was appointed as a Police Constable with the respondents and while discharging his duties he expired on 17.12.2017. The grievance of petitioner is that she has submitted representation to the respondents on 08.02.2018 to consider her case for appointment on compassionate grounds. But, so far, the respondents have not considered the case of the petitioner nor passed any orders on the representation submitted by the petitioner.

Learned counsel for petitioner submits that appropriate orders be passed in the writ petition directing the respondents to consider

the case of the petitioner for appointment on compassionate grounds in any suitable post.

Learned Special Government Pleader appearing for respondents has contended that the case of the petitioner will be considered in accordance with law and appropriate orders would be passed on the representation submitted by the petitioner. This Court, having considered the rival submissions, is of the considered view that the writ petition can be disposed of directing the respondents to consider the representation submitted by the petitioner on 08.02.2018 and pass appropriate orders in accordance with law within a period of four weeks from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.
