Heard Mr.Ravi Kumar holding for Ms.M.Rajeshwari and the learned Assistant Government Pleader for Irrigation. The c ounsel for petitioners c ontends that the respondents are trying to interfere with the petitioners' possession and enjoyment of the subject matter of writ petition, without recourse to law.
The Assistant Government Pleader places on record the written instructions dated 20.04.2017. The operative portion reads as follows :- " .... The contractor has executed jungle clearance, silt removal and some part of the bund for amount of Rs.3.72 lakhs against Rs.18.40 lakhs. The farmer namely Sri Madura Banaiah has objected the work stating that his lands are coming under submergence of the tank. The office has approached the Revenue authorities for verification of his lands in tank and the work was stopped without attempting the weir and sluice. Hence, there is no question of new submergence land under the tank. The work was closed and final bill was submitted to APAO, Mancherial for payment."
The statement is placed on record.
The respondents are directed not to interfere with the petitioner's possession and enjoyment except in accordance with law.
The writ petition is disposed of accordingly. No order as to costs.
