THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.1815 OF 2018 ORDER:

This petition is filed by the petitioners-A1 to A3 under Section 482 Cr.P.C. to quash the proceedings in Cr.No.19 of 2018 on the file of the Station House Officer, Huzurnagar Police Station, Suryapet District, which was registered for the offences punishable under Sections 504 r/w 34 IPC and 3 (1) (r) (s) of SCs & STs (POA) Amendment Act, 2015. 2.

Heard learned counsel for the petitioners, learned Public Prosecutor representing the State and perused the record.

Learned counsel for the petitioners would submit that there are differences among the Cooks in the school. The 2nd respondent-de facto complainant is Ex-Cook. She bore grudge against the petitioners and foisted this case. No incident as alleged took place. Further, the alleged incident said to have been taken place on 05.01.2018, but the report was lodged with the police on 27.01.2018 and ultimately, prayed to allow the petition.

On the other hand, learned Assistant Public Prosecutor opposed the relief sought for by the petitioners in the petition.

As seen from the report lodged with the police on 27.01.2018, the alleged incident took place on 05.01.2018 during morning hours. There are differences between the parties to the litigation. The truth or otherwise of the allegations is required to be investigated. There are no merits to concede the request of the petitioners. All the petitioners are women.

Having regard to the allegations, the Station House officer/Investigating Officer concerned is directed to complete the investigation in this case and file charge sheet or final report as the case may be, without arresting the petitioners-A1 to A3 7.

With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any pending in this Criminal Petition shall stand closed.
