THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.32795 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking a direction to the respondents-police to register a case basing on the complaint of the petitioner dated 24.08.2016 against the respondents 5 & 6.

The main grievance of the petitioner is that the Station House Officer, Makthal Police Station, Mahabubnagar District is not registering a case against the respondents 5 & 6 basing on the complaint lodged by the petitioner dated 24.08.2016.

The learned Additional Government Pleader submitted that so far no complaint is pending with the 4th respondent and if a complaint is lodged, the 4th respondent will investigate into the matter in accordance with law.

Considering the facts and circumstances of the case, the petitioner is directed to lodge a complaint as alleged in the petition and on such complaint, if it discloses any cognizable offence, the 4th respondent shall register a case, investigate into the same and file a final report if any. further, if the petitioner is aggrieved by the action of the 4th respondent, he is at liberty to approach the superior officer of 4th respondent and also to approach the concerned Court by invoking provision under Section 200 Cr.P.C.

Accordingly, the writ petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. _________________ RAJA ELANGO,J 17.10.2016.
