ORDER:

The petitioner is an Anganwadi Helper of Dennevarikottalu Anganwadi Centre in Proddatur Town. The petitioner challenges the non-consideration of the claim of the petitioner for appointment as Anganwadi Worker in the Dennevarikottalu Anganwadi Centre even though the petitioner is eligible and qualified and resorting to open market recruitment.

2. When the matter is taken up, learned counsel for the petitioner placed before this Court the order passed by this Court in W.P.No.35553 of 2015 on 30.10.2015, concerning the Anganwadi Centers in Proddatur Town. This Court passed the following order:

"In the above facts and circumstances of the case, respondent No.3 is directed to consider the cases of the petitioners for being appointed,

along with the claims of the other Anganwadi Helpers, as Anganwadi Workers and appoint the best from among the candidates recommended by respondent No.5, vide Letter No.10/SA/2015, dated 22.8.2015. It is only in the event, respondent No.3 does not find any of the candidates recommended by respondent No.5 in the abovementioned letter suitable, then only he is entitled to consider others for being appointed as Anganwadi Workers of Dinnemeddi Kottala and Jabbar Shed."

Following the same, this Writ Petition is also disposed of directing the respondent authorities to consider the entitlement of the petitioner for promotion/appointment as Anganwadi Worker in Dennevarikottalu Anganwadi Centre in Proddatur Town along with the four other Helpers of the same Town and consider the petitioner for appointment subject to the eligibility of the petitioner vis-à-vis, the other applicants. If only in the event the competent authority has not found any of the Anganwadi Helpers applied to the post of Anganwadi Worker in Dennevarikottalu Anganwadi Centre in Proddatur Town, the competent authority is entitled to consider others for being appointed as Anganwadi Workers of Dennevarikottalu Anganwadi Centre in Proddatur Town. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
