Heard Sri B.S.N.Naidu, learned counsel appearing for the petitioner, learned Government Pleader for Endowments and Mrs. K. Lalitha, learned standing counsel for the 6th respondent.

2. Learned counsel appearing for the petitioner submits that the 3rd respondent, who issued proceedings in Letter in Rc.No.A2/2701/ 2014, dated 20.08.2014, is not competent to issue such proceedings.

3. Having gone through the submissions made on either side and also relevant provisions of the Endowments Act, this court is of the view that the 3rd respondent is not competent to issue the impugned proceedings. Therefore, the enquiry held pursuant to the said proceedings is not valid. Hence, the impugned proceedings, as well as the enquiry held so far, are set aside and the matter is remitted back to the Executive Authority to take appropriate action in terms of Section 37 of the Endowments Act.

4. The writ petition is accordingly disposed of. Miscellaneous petitions, if any, in this writ petition, shall stand closed. No order as to costs.
