SMT JUSTI CE T. RAJANI CRI MI NAL PETI TI ON No.7 4 3 4 of 2 0 1 3 ORDER:

This petition is filed, by the petitioners, seeking for quash of the proceedings against them in C.C.No.486 of 2010 on the file of XIII Additional Chief Metropolitan Magistrate at Nampally, Hyderabad.

2.

Heard the counsel for the petitioners and the Public Prosecutor appearing, for the 1st respondent as well as the counsel appearing for the 2nd respondent.

3.

The counsel for the petitioners submits that on 19.07.2018 this court recorded that the daughter of the complainant, who is the victim in this case, appeared before this court and stated that she and A1 have amicably settled the disputes and are living together since few months after the registration of the complaint, which was lodged in the year 2010. The court also recorded that she further submitted that if her in-laws come for a compromise with amicable terms, she has no objection. 4.

However, since then, as per the contention of the counsel for the petitioners, she did not come for any amicable settlement. However, it appears that the petitioners herein are the sister-in-law of the victim and the husband of her sister-inlaw. Considering the fact that they are married persons and that A1 and the victim are living together since more than eight

years, this court opines that continuation of further proceedings against these petitioners would only result in abuse of process of law. More so, when the grievances expressed in the complaint are importantly against A1, with whom the victim has entered into the compromise and is living with amicably. 5.

In view of the above, this court opines that continuation of further proceedings against the petitioners would be an abuse of process of law.

6.

With the above observations, the Criminal Petition is allowed and the proceedings against the petitions in C.C.No.486 of 2010 on the file of XIII Additional Chief Metropolitan Magistrate at Nampally, Hyderabad, are hereby quashed. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
