HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.3948 of 2015 ORDER :

This Criminal Petition is filed by the Petitioner/accused No.1 under Section 482 Cr.P.C seeking to quash the proceedings in C.C. No.211 of 2013 on the file of XV Additional Chief Metropolitan Magistrate, Hyderabad registered for the offences punishable under Sections 498-A, 506 read with 34 I.P.C.

2) Heard the learned counsel for Petitioner and the 2nd respondent-State representing the Public Prosecutor before ordering notice to the 1st respondent-defacto-complainant and before admission and perused the material. As the facts no way deserve admission of the application under section 482 Cr.P.C. but for to observe the remedy of the petitioner is to move an application for anticipatory bail or regular bail and recall the N.B.W already issued after post cognizance, if law provides. In such an event, the learned Magistrate shall consider to grant bail on the same day, if not possible even on the next day.

4) With the above observations, the criminal petition is disposed of.
