THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5329 OF 2015 ORDER:

This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioner/A.3 seeking to grant bail in connection with crime No.41 of 2015 on the file of the P.S., Dundigal, Cyberabad, Ranga Reddy District, registered for the offences under Section 20(b)(ii)(c) read with 27(A) and Section 29 of the Narcotic Drugs and Psychotropic Substances Act (NDPS Act).

Heard.

Learned counsel for the petitioner/A.3 submitted that the petitioner is only watchman to the firm and he is in no way connected to the offence as alleged by the prosecution and hence, he prays this Court to release the petitioner/A.3 on bail.

This Court is of the view that even though it is alleged by the learned counsel for the petitioner/A.3 that he is a watchman, the fact remains that A.1 promissed to pay Rs.10,000/- to A.3 and directed him to keep the ganja leaves in his possession, for that the petitioner/A.3 accepted the same and found in possession of ganja leaves. Hence, this Court is of the view that it is not a fit case to grant bail to the petitioner/A.3.
