THE HON'BLE Dr . JUSTI CE SHAMEEM AKTHER CRI MI NAL PETI TI ON No.1 6 3 4 of 2 0 1 9 ORDER:

This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioner to modify the order dated 01.03.2019 in Crl.M.P.No.18 of 2019 in Crl.A.No.172 of 2019 on the file of the XIII Additional Metropolitan Sessions Judge, Cyberabad at L.B. Nagar, Rangareddy District. 2.

Heard both sides. Perused the record.

3.

Learned counsel for the petitioner contends that the trial Court directed the petitioner to deposit 20% of the compensation amount. He also contends that 10% of the compensation is already deposited.

4.

The matter is already under adjudication before the trial Court. The contention is that there was no legally enforceable debt and the subject debt was not given. These are required to be raised in the appeal. It is too early to consider the said submission. When there is already a finding against the petitioner by the trial Court, the imposition of condition to deposit 20% of compensation amount is justified. The petition is devoid of merit and is liable to be dismissed.

5.

In the result, the Criminal Petition is dismissed. Pending miscellaneous petitions, if any, shall stand closed. _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ Dr . SHAMEEM AKTHER, J Date: 29.03.2019.
