ORDER:
With the consent of the learned counsel for the petitioner, the learned Government Pleader for Municipal Administration for the 1st respondent and Sri V. Narasimha Goud, learned Standing Counsel for respondents 2 and 3, this writ petition is disposed of at the admission stage.
2. On 23.02.2012, the order of allotment was issued granting lease of the subject premises for a period of three years effective from 01.03.2012 to 28.02.2015.
On 09.03.2015, the petitioner applied for renewal of lease. At that stage, the petitioner was called upon to pay arrears of amount due upto April, 2014 and rent from May, 2014 onwards along with maintenance charges and service tax and interest. He was informed that only on clearance of the amounts due, application for renewal would be considered. In response to the notice, dated 27.03.2015, the petitioner submitted representation on 31.03.2015 requesting to grant six installments to pay the balance amount as per the notice, dated 27.03.2015.
3. Alleging that no orders are passed on the said representation and on the contrary, the respondents are taking active
steps to knock away the premises, this writ petition is filed.
4. When the matter is taken up for consideration, the learned counsel for the petitioner submits that the petitioner would be satisfied if the writ petition is disposed of by directing the Metropolitan Commissioner, Hyderabad Metropolitan Development Authority (2nd respondent) to consider the request of the petitioner made on 31.03.2015.
5. Accordingly, the Writ Petition is disposed of by directing the Metropolitan Commissioner, Hyderabad Metropolitan Development Authority (2nd respondent) to consider the prayer of the petitioner made in his representation, dated 31.03.2015, regarding grant of installments to pay the arrears due along with penal charges, etc., consider the same and pass orders within a period of three (3) weeks from the date of receipt of a copy of this order. It is made clear that no opinion is expressed on the merits of the case. There shall be no order as to costs.
