HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.18568 of 2001 ORDER :

When the matter is taken up for hearing, the learned Standing Counsel appearing for the respondents has contended that the grievance of the petitioners has been resolved, as the respondents have paid pensionary benefits to the petitioners.

Learned counsel appearing for the petitioners has contended that the respondents have not paid revised commutation of pension. Therefore, appropriate orders be passed in the writ petition directing the petitioners to submit a fresh representation to the respondents seeking revised commutation of pension, so as to enable the respondents to consider the same and pass appropriate orders in accordance with law.

This Court, having considered the rival submissions made by the learned counsel for the respective parties, is of the considered view that this writ petition can be disposed of directing the petitioners to submit a fresh representation to the respondents seeking revised commutation of pension within two weeks from the date of receipt of a copy of this order. Upon such representation being filed, the respondents shall consider

the same and pass appropriate orders in accordance with law within four weeks thereafter.

With the above observations, the writ petition is disposed of. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
