HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL REVISION CASE No.286 of 2019 ORDER :

Heard before notice to respondent No.2 and before admission, the learned counsel for the petitioner/accused and the learned Public Prosecutor, representing the State and perused the impugned order of the learned II Special Magistrate Court at Erramanzil, Hyderabad, in Crl.M.P.No.712 of 2019, dismissing warrant recall application, without even presence of the accused in C.C.No.74 of 2018, even Non Bailable Warrant issued from service of notice, for his failure to attend as such from perusal of the order there is nothing to interfere, but for to say now by virtue of this order, liberty is available to appear in person and file fresh application for recall of warrant to consider, subject to execution of bond with or without sureties as contemplated by Section 88 of Cr.P.C., if not already executed and if at all executed by imposing penalty on earlier bond for non appearance. Accordingly, the revision is disposed of.
