THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.5052 of 2018 ORDER:
Heard learned counsel for the petitioner, learned Government Pleader for Mines & Geology appearing for respondent Nos.1, 3 and 4 and Sri V.Pratap Reddy, learned Standing Counsel, appearing for the second respondent. When the matter is taken up, it is submitted by the learned counsel for the petitioner that the issue, in the present Writ Petition, is squarely covered by the order of this Court, dated 25.04.2018, passed in W.P.No.7440 of 2018. A copy of the said order is placed on record. Operative portion of the said order reads as under:
"I do not see any reason why DLSC should again reexamine and grant fresh approval for excavation when it is not the case of respondents that the earlier approval granted by the DLSC is incorrect and made without application of mind.
Therefore, the 2nd respondent shall strictly adhere to the timelines mentioned in Memo No.2121/ M.I(1)/2018-1 dt.16-04-2018 and Memo No.2121/ M.I (1)/2018-3 dt.1804-2018 and decast the sand from the lands of petitioners". Following the above said order, and for the reasons recorded therein, this Writ Petition is also disposed of in terms thereof. There shall be no order as to costs.
Office to enclose copy of the order, dated 25.04.2018, in W.P.No.7440 of 2018 to this order.
Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
