THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.535 of 2016 ORDER :

In this Writ Petition the petitioner has questioned proceedings dt.26.12.2015 of 2nd respondent suspending petitioner's Fair Price Shop dealership authorization and also mentioning the charges framed against the petitioner, inviting an explanation for the same.

The counsel for petitioner contended that although he has submitted an explanation to the charges on 26.12.2015 to the 2nd respondent, the 2nd respondent has ignored it and passed the order of suspension. 3.

In view of the said contention, the learned Government Pleader has suggested that petitioner submit a copy of the explanation again to the 2nd respondent within one week from the date of receipt of the copy of the order and stated that the 2nd respondent will then conduct enquiry as provided in sub-clause (5) of Section 5 of the Andhra Pradesh State Public Distribution System (Control) Order, 2008 and pass order thereon.

4. In view of the submission, the petitioner is directed to furnish fresh explanation to the show-cause within one week from the date of receipt of a copy of this order to the

2nd respondent, and the 2nd respondent is directed to consider the same, conduct enquiry as per the provisions of the standing order referred to above, provide a personal hearing to petitioner, and then pass a final order in accordance with law.

The said exercise shall be completed on or before 31.03.2016.

Accordingly, the Writ Petition is disposed of with the above directions. No order as to costs.
