SMT JUSTICE T.RAJANI CRIMINAL PETITON No.1843 OF 2018 ORDER:
This petition is filed seeking for modification of the condition imposed by the Metropolitan Sessions Judge, Hyderabad in Crl.M.P.No.247 of 2018 in Crl.A.No.51 of 2018, while suspending the sentence imposed against the petitioners. The condition is that the petitioners should deposit half of the cheque amount, which comes to Rs.7,50,000/- .

The counsel for the petitioner, now, submits that P.W.1 admitted in his evidence that Rs.10,00,000/- (rupees ten lakhs only) was paid to him and that there is no liability. But, however, the court observed that P.W.1 stated that it pertains to the previous transaction. The counsel submits that there is only one transaction between the parties.

Hence, considering the above facts, this Court opines that the said condition is onerous and hence, the same is set aside. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
