HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.713 of 2015 ORDER:

This petition is filed to withdraw O.P.No.2 of 2015 from the file of Senior Civil Judge, Mahabubabad, Warangal and transfer the same to Family Court, Ranga Reddy District at L.B. Nagar.

2. Wife filed this petition. According to her affidavit, her marriage was solemnized with respondent on 18.06.2003 and they lived happily for about 6 months and thereafter respondent started harassing her both physically and mentally as she is unable to bear harassment, she left marital home and residing with her parents and she lodged a complaint with Station House Officer, Kukatpalli Police Station, which is registered as Crime No.73 of 2012 under Section 498-A IPC and Sections 3 and 4 of Dowry Prohibition Act, and subsequently the same is registered as C.C.No.2545 of 2012 and pending before IX Metropolitan Magistrate, Kukatpalli. She also stated that she filed DVC No.47 of 2014 before IX Metropolitan Magistrate, Kukatpalli and the same is also pending for adjudication. She stated that respondent filed O.P.No.

2 of 2015 before Senior Civil Judge, Mahabubabad only to harass her. She stated that she is completely dependent on her parents and her children are admitted in a school at Jagadgirigutta and her parents are meeting the educational expenses and that she is not in a position to meet travel expenses from Jagadgirigutta to Mahababuad, Warangal District to attend the Court for each and every adjournment in O.P. No.2 of 2015 and the distance between Kukatpalli and Mahabubabad is more than 200 KMs. For these reasons, she prayed for transfer of O.P.No.

Ranga Reddy District at L.B. Nagar.

3. Respondent in spite of service of notice neither appeared in person nor through any advocate.

4. Heard arguments.

Considering the reasons stated in the affidavit and also considering the convenience of wife, O.P.No.2 of 2015 is withdrawn from the file of Senior Civil Judge, Mahabubabad, Warangal District and transferred to Family Court, Ranga Reddy District at L.B. Nagar for disposal in accordance with law.

6. Accordingly, the Transfer Civil Miscellaneous Petition is ordered. No costs. Miscellaneous Petitions, if any pending, in this petition, shall stand closed.
