ORDER:

Petitioner alleges that Station House Officer, Kothagudem I Town Police Station (3rd respondent) is repeatedly calling the petitioner to the Police Station and forcing him to settle the disputes with the respondent no.5, and the same is illegal, arbitrary, unconstitutional, and seeks direction to respondents 1, 2 and 4 to take necessary action against 3rd respondent for his illegal involvement in family disputes.

Based on the written instructions furnished by the Inspector of Police, Khammam I Town Police Station, learned Government Pleader submits that 5th respondent lodged complaint on 23.03.2019 alleging harassment by the petitioner and his family members physically and mentally and demanding to bring additional dowry. After making General Diary entry, Police are asking the petitioner to come to Police Station to refer for counselling, in accordance with the principles laid down by the Hon'ble Supreme Court in Lalita Kumari v. Government of Uttar Pradesh and others1, but there is no harassment meted out to the petitioner.

Written instructions do not disclose issuance of notice to the petitioner and complaint alleged to have been lodged by the 5th respondent.

Police shall not unnecessarily harass the petitioner by calling him to the Police Station, unless required in the process of 1 (2014) 23 SCC 1

investigation into the crime reported. Writ Petition is accordingly dismissed. This order does not come in the way of referring to counselling, if required. Pending miscellaneous petitions shall stand closed.
