HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY Writ Petition No.5488 of 2005 ORDER: (Per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) This is an old matter of the year 2005. By this writ petition, the petitioner challenged the demand notice issued by the respondent on 16.12.2003. By this notice, a sum of Rs.6,76,739/- has been demanded on account of House Tax.

While entertaining the writ petition, this Court was pleased to grant interim suspension on 25.3.2005. Since then the interim suspension is in operation. No counter affidavit has been filed to challenge the same nor any attempt has been made by the respondent to get the aforesaid interim order vacated. Under the circumstances, we think that justice would be sub-served if the following order is passed. The Executive Officer, Gram Panchayat, Chinnaoutapalli is directed to consider the petitioner's representation dated 13.11.2004 after giving personal hearing to the petitioner and by passing a speaking order. The entire exercise shall be completed within a period of six weeks from the date of communication of this order. The writ petition is accordingly disposed of. Pending miscellaneous applications, if any, shall also stand closed. No order as to costs.
