THE HON'BLE SRI JUSTI CE S.V.BHATT CONTEMPT CASE No.1 2 2 6 of 2 0 1 6 ORDER:

Heard Mr. L. Prabhakar Reddy, learned Government Pleader and Mr. T. Sudhakar Reddy.

The contempt case is filed complaining disobedience of order dated 02.07.2001 in WP.No.2261 of 1997. The operative portion reads as follows:

"Under these circumstances, the Writ Petition is disposed of with a direction that the petitioner shall file a representation before the Land Acquisition Officer-4th respondent within a period of four weeks from the date of receipt of a copy of this order and 4th respondent shall consider the same and pass appropriate Orders within a period of eight weeks thereof. He shall pass an award in accordance with the notification published under Section 4(1) of the Land Acquisition dated 25-5-1993. The Land Acquisition Officer shall deposit the amounts so awarded before the Civil Court duly referring the matter under Section 30 and 31(2) of the Land Acquisition Act." 3.

The fifth respondent filed counter affidavit and also a few annexures to show that the order has been duly complied with so far as Hyderabad Metropolitan Water Supply and Sewerage Board (HMWS&SB) is concerned and it is for the Land Acquisition Officer to take further steps in the matter.

Learned Government Pleader (Land Acquisition), on instructions, states that the compensation determined by the department was communicated to HMWS&SB.

HMWS&SB in turn through communication dated 03.10.2016, sent cheque for Rs.15,08,936/ - and

the communicated and the cheque was acknowledged by the revenue department on 04.10.2016.

The Revenue Divisional Officer, Deverakonda Division will take all the steps needed for completion of the other directions issued in this behalf at the earliest. 5.

Having perused the annexures filed along with the counter affidavit, Mr. L. Prabhakar Reddy does not press the contempt case for the present. However, seeks leave to revive the contempt case, if the Revenue Divisional Officer fails to do the needful within reasonable period.

The contempt case is closed by granting liberty as prayed for. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
