SMT JUSTICE T.RAJANI CRIMINAL PETITON No.1823 OF 2018 ORDER:

This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A1, in Crime No.115 of 2017 on the file of Bapatla Town Police Station, Guntur District. The offences alleged are under Section 420 r/w 34 IPC.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

The case of the prosecution is that one Vigneswara Traders, which is represented by A2, supplied cotton bales to the defacto complainant, which are found to be defective and that in fact Vigneswara Traders is a benami company of A1. The counsel for the petitioner submits that the petitioner does not have anything to do with Vigneswara Traders. But the public prosecutor, in support of his contention that this petitioner is in-charge of the affairs of Vigneswara Traders, relies on mail conversation between the defacto complainant and accused No.1, wherein some allegations are made by defacto complaint against A1.

Hence, prima facie, it appears that there is some nexus between A1 and Vigneswara Traders. The public prosecutor further submits that the investigation is still in progress and that unless the said investigation is completed, the exact role of this petitioner, in the alleged offence, would not come out. 5.

Hence, in view of above facts, this court opines that this is a not a fit case for granting anticipatory bail.

Accordingly, the Criminal Petition is dismissed. As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed.
