This petition is filed under Section 438 of the Code of Criminal Procedure, 1978, by the petitioner/accused seeking pre-arrest bail in Crime No.31 of 2017 of Vatsavai Police Station, Krishna District, which was registered against the petitioner for the offence punishable under Section 353 IPC.

The accusation is that when the petitioner was constructing the temple encroaching the public rastha, the de facto complainant, who is a Village Secretary, went and questioned, the accused behaved highhandedly by pushing him and obstructed his official duties. The complaint lodged by the de facto complainant was registered as Crime No.31 of 2017 and investigation is reported to be pending.

Having regard to the nature of accusation, it is not a fit case to grant Anticipatory Bail to the petitioner. The petitioner/accused is directed to surrender before the Judicial Magistrate of First Class, Jaggaiahpet, Krishna District, on or before 27.07.2017 and seek for a regular bail, in which case, the learned Magistrate shall dispose of the bail application on merits on the same date.
