HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.6022 of 2019 ORDER:

The prayer of the petitioner in this case reads as under:- "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not considering and disposing of the application of the petitioner for regularization of the building and the land vide representations/applications dated 25.11.2015 and 19.01.2015 submitted to Respondent No.4 as being arbitrary, illegal, unreasonable, violative of principles of natural justice, contrary to the provisions of the Scheme of the Government issued in G.O.Ms.No.508 Revenue Department dated 20.10.1995 and G.O.Ms.No.59 Revenue Assignment-II Department dated 30.12.

2014 and violative of Articles 14 21 and 300A of the Constitution of India and issue consequential direction directing the respondents to consider the application of the petitioner for regularization with a further direction to Respondent No.7 not to take coercive steps of demolition of the residential building of the petitioner built in Plot No.377, Road No 10, Jubilee Hills, Hyderabad, and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case."

Learned Assistant Government Pleader for Revenue, State of Telangana, informed this Court on 22.3.2019 that the application of the petitioner was already considered on merits and rejected. He sought time to produce a copy of the rejection order. Today, the learned Assistant Government Pleader produced a copy of the Memo dated 20.9.2015 issued by the Tahsildar, Shaikpet Mandal, Hyderabad District, whereby he considered the petitioner's application dated 28.02.2015 and rejected his claim for regularisation on the ground that the land in question formed part of a park in Jubilee Hills Housing Co-Operative Society layout at Hyderabad. He undertakes to furnish a copy of the aforestated

SK, J WP.No.6022 of 2019 Dt:27.3.2019 Memo dated 20.9.2015 to Sri T.S.Anirudh Reddy, learned counsel for the petitioner.

In the light of the aforestated Memo dated 20.9.2015, the complaint of the petitioner as to inaction upon his regularisation application stands settled. In the event the petitioner is aggrieved by the rejection vide Memo dated 20.9.2015, it is for him to take appropriate remedial measures in accordance with law. Leaving it open to him to do so, the Writ Petition is dismissed. Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
